
These Standard Sales Terms and Conditions (“Terms”) apply to the purchase and enrolment of tuition courses, educational programmes, classes, workshops, activities and other related services (“Services”) provided by Modern Youth Learning Centre / 現代優賢學習中心 (“Modern Youth Learning Centre”, “we”, “us” or “our”).
By enrolling in, purchasing or using our Services, the student, parent, guardian or other purchaser (“Customer”, “you” or “your”) agrees to be bound by these Terms. Where the student is under the age of 18, the person enrolling the student or making payment on the student's behalf confirms that they are the student's parent or legal guardian, or are otherwise authorised to act on the student's behalf.
Course enrolment is subject to availability and is only confirmed when the relevant enrolment information has been provided; the required fees have been paid or an approved payment arrangement has been made; and Modern Youth Learning Centre has confirmed the enrolment.
Submitting an enquiry or registration form does not, by itself, guarantee a place in a course. Places in classes may be limited and enrolment will generally be processed on a first-come, first-served basis, subject to class availability and any applicable admission requirements.
We reserve the right to refuse or cancel an enrolment where reasonably necessary, including where the course is full; the course has been cancelled or discontinued; the information provided is inaccurate or incomplete; payment has not been received; the enrolment would create operational or safety concerns; or otherwise permitted by applicable law.
Course information, including course content, class schedules, teachers, venues, lesson arrangements and fees, may be subject to change. We will endeavour to provide reasonable notice of significant changes whenever practicable.
Modern Youth Learning Centre reserves the right to amend course content; change teaching materials; change the teacher or instructor; change the class schedule; change the classroom or teaching venue; combine classes; reschedule lessons; or make other reasonable operational adjustments.
Any images, descriptions, illustrations, sample materials or promotional content published on our website or other communication channels are for general information purposes. Actual teaching materials, classroom arrangements and lesson content may vary.
All course fees are stated in Hong Kong dollars unless otherwise specified. Course fees must be paid by the deadline specified by Modern Youth Learning Centre. A place in a course may not be reserved until the required payment has been received and the enrolment has been confirmed.
Unless otherwise expressly stated, course fees do not include textbooks; supplementary materials; examination fees; external registration fees; transportation costs; or other costs not expressly included in the course description.
Where a payment is declined, reversed, cancelled or otherwise not successfully completed, the Customer remains responsible for any outstanding amount properly due. We reserve the right to suspend or cancel enrolment where fees remain unpaid.
Promotions, discounts, trial lessons, introductory offers, referral offers and other special offers are subject to their specific terms and conditions. Unless otherwise stated, promotional offers cannot be exchanged for cash; promotions cannot be combined with other offers; promotions are subject to availability; and promotions may be subject to a specified validity period.
Modern Youth Learning Centre reserves the right to amend, suspend or withdraw a promotion where reasonably necessary, subject to applicable law.
Unless otherwise expressly stated in writing or required by applicable law, course fees are generally non-refundable after enrolment has been confirmed and the course place has been reserved. A refund, credit or transfer may be considered at Modern Youth Learning Centre's discretion in exceptional circumstances.
Any request for cancellation, withdrawal, refund or transfer should be submitted as soon as possible and should include the student's name; the course name; the relevant class or course period; the reason for the request; and the relevant payment or enrolment information.
Where a refund is approved, any applicable administrative, payment-processing or other reasonable charges may be deducted where permitted by law. A refund will generally be made to the original payment method where practicable.
The following circumstances will not normally entitle a Customer to a refund: absence from a lesson; late arrival; failure to attend a class; change of personal schedule; change of school schedule; holidays or travel; failure to complete homework or coursework; or dissatisfaction with academic results alone. This clause is subject to any rights that cannot lawfully be excluded or limited.
If a student is unable to attend a lesson, the Customer should notify Modern Youth Learning Centre as soon as reasonably practicable. Unless otherwise stated for a particular course, missed lessons do not automatically entitle the student to a refund; a reduction in course fees; a replacement lesson; or a transfer of the missed lesson to another course.
Where operationally feasible, Modern Youth Learning Centre may offer a make-up lesson, alternative arrangement or other form of support at its discretion. Make-up arrangements are subject to availability and may be subject to specific conditions.
Modern Youth Learning Centre may reschedule or alter a lesson where reasonably necessary, including due to teacher availability; operational requirements; venue issues; severe weather; public health considerations; government requirements; technical issues; or other circumstances beyond our reasonable control.
Where a lesson is cancelled or rescheduled by Modern Youth Learning Centre, we will endeavour to provide reasonable notice and, where appropriate, offer an alternative arrangement such as a replacement lesson; an alternative class; an online lesson; a credit arrangement; or another reasonable arrangement.
Lessons may be cancelled, postponed, rescheduled or changed to an alternative format due to circumstances affecting the safety or reasonable operation of the Centre, including typhoons, rainstorms, flooding, transportation disruption, government announcements, public health emergencies, power or network failures, or other events beyond our reasonable control. Modern Youth Learning Centre will endeavour to communicate relevant arrangements through appropriate channels.
Students are expected to behave respectfully towards teachers, staff and other students; follow reasonable instructions; respect Centre property and facilities; avoid disruptive or unsafe behaviour; and comply with applicable Centre rules.
Modern Youth Learning Centre may take reasonable action where a student's behaviour seriously disrupts teaching, creates a safety concern or adversely affects other students, including contacting a parent or guardian; issuing a warning; requiring the student to leave a lesson; suspending participation; or terminating enrolment where reasonably necessary. Where enrolment is terminated due to serious misconduct, the Customer may not be entitled to a refund, subject to applicable law.
Parents and guardians are responsible for providing accurate information relevant to the student's participation in the Services, and should inform Modern Youth Learning Centre of any relevant circumstances that may reasonably affect the student's participation, safety or ability to take part in a course or activity.
Parents and guardians are responsible for making appropriate arrangements for the student's arrival and departure from the Centre unless a separate arrangement has been expressly agreed. Modern Youth Learning Centre will take reasonable steps to provide a safe learning environment, but parents and guardians remain responsible for supervising students outside the agreed scope of the Services.
Modern Youth Learning Centre aims to provide quality educational support and learning opportunities. However, we do not guarantee any particular examination result; academic grade; school admission result; interview result; language proficiency result; learning outcome; or other specific educational outcome. Academic progress may depend on many factors, including attendance, effort, participation, prior knowledge, study habits, individual ability and other circumstances.
All teaching materials, worksheets, notes, exercises, course content, presentations, videos, graphics, designs and other materials provided by or on behalf of Modern Youth Learning Centre remain the property of Modern Youth Learning Centre or the relevant rights holder, unless otherwise stated. Materials provided to students are for personal educational use only.
Unless prior written permission has been obtained, students and Customers must not reproduce, copy, distribute, sell, publish, upload, share publicly, commercially exploit or otherwise make available any teaching materials or course content. Students and Customers must not record, photograph, livestream or distribute lessons, teachers or other students without prior permission and, where applicable, the consent of relevant individuals.
Modern Youth Learning Centre may occasionally take photographs or videos during educational activities, events or promotional activities. Where required, we will seek appropriate consent before using identifiable photographs, videos or recordings for promotional or other specified purposes. Parents or guardians may contact us if they have questions about the use of images or recordings involving a student. The collection and use of personal data, including images where applicable, is subject to our Privacy Policy Statement and Personal Information Collection Statement.
Personal data will be collected, used, stored and handled in accordance with our Privacy Policy Statement, our Personal Information Collection Statement, and applicable data protection laws and regulations. By providing personal data to us, you confirm that the information provided is accurate and that you have the necessary authority to provide information relating to another person, where applicable.
Modern Youth Learning Centre may communicate with students, parents and guardians using contact information provided during enquiry, registration or enrolment, including course information, class arrangements, schedule changes, payment reminders, administrative notices, educational activities and other matters relating to the Services. You are responsible for ensuring that your contact information is accurate and up to date, and should notify us if your telephone number, WhatsApp number, email address or other relevant contact information changes.
We may use third-party service providers to support our operations, including providers of payment services; website and technology services; communication services; administrative services; and other services reasonably necessary for our operations. Where appropriate, third-party services may be subject to the third party's own terms and privacy policies.
To the maximum extent permitted by applicable law, Modern Youth Learning Centre will not be liable for loss or damage arising from circumstances beyond our reasonable control. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law, or affects any statutory rights or remedies that cannot lawfully be excluded or restricted.
Modern Youth Learning Centre will not be responsible for failure or delay in providing Services caused by events beyond our reasonable control, including natural disasters, severe weather, fire, flood, epidemic or pandemic, government action, public health measures, transportation disruption, power failure, telecommunications or internet failure, labour disputes, civil disturbance or other similar circumstances. We will endeavour to take reasonable steps to minimise disruption where practicable.
Modern Youth Learning Centre may update these Terms from time to time. The latest version will be published on our website and will include the relevant revision date. Changes will generally apply to future enrolments and transactions unless otherwise required by law.
These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any dispute arising in connection with these Terms shall be subject to the applicable jurisdiction of the courts of the Hong Kong Special Administrative Region, subject to applicable law.
If any provision of these Terms is found to be invalid, illegal or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it valid and enforceable, where permitted by law. The remaining provisions will continue in full force and effect.
These Terms, together with the relevant course information, enrolment information, applicable promotional terms, Privacy Policy Statement and Personal Information Collection Statement, form the terms applicable to the relevant purchase or enrolment. If there is any inconsistency between these Terms and a specific written course or promotional term, the specific term will apply to the extent of the inconsistency.
